Rules for invitation, approval of invitations for entry into the Republic of Kazakhstan of foreigners and stateless persons, as well as issuance, cancellation and reissue the visa of the Republic of Kazakhstan and its term extension and reduction

1. General provisions

1. These Rules for invitation and approval of invitations for entry into the Republic of Kazakhstan of foreigners and stateless persons, as well as issuance, cancellation and reissue the visa of the Republic of Kazakhstan and its term extension and reduction (hereinafter – the Rules) have been developed in accordance with the Migration Law of the Republic of Kazakhstan dated July 22, 2011 (hereinafter – the Migration Law), and determines procedural formalities of the invitation, approval of the entry to the Republic of Kazakhstan of foreigners and stateless persons (hereinafter – visa recipients), as well as issuance, cancellation and reissue the visa of the Republic of Kazakhstan and its term extension and reduction.

2. If an international treaty, where the Republic of Kazakhstan is a party, stipulates the other regulations, the rules of the international treaty shall apply. 

3. The following definitions are used in these Rules:

1) Stateless person - is a person, who is not a national of the Republic of Kazakhstan and has no proof of nationality of another state; 

2) Business immigrant - is an immigrant, who has arrived to carry out business activities in accordance with the Law; 

3) Former compatriot - is a person, who was born or previously was a national of the Kazakh Soviet Socialist Republic or the Republic of Kazakhstan; 

4) ‘Berkut’ information system - (hereinafter – ‘Berkut’) is a unified information system to control of entry and exit, staying of foreigners and stateless persons in the Republic of Kazakhstan;

5) Note verbal is a written request from foreign offices, diplomatic and equivalent representative offices, consular institutions of foreign states, international organizations and their representatives, including for the purpose of invitations and visa issuance to foreigners and stateless persons;

6) Visa-immigration portal (hereinafter – VMP) is a portal designed to automate the paperwork associated with migration procedures (www.vmp.gov.kz );

7) Religious activity - is an activity to provide the religious needs of religious followers;

8) Entry and exit permit (hereinafter – the visa) is a mark of authorized state agencies of the Republic of Kazakhstan in the migrant’s passport or an equivalent document, which gives the right to enter the territory of the Republic of Kazakhstan, travel through its territory, stay and leave the territory of the Republic of Kazakhstan for the period, for the purpose of and under conditions specified in the visa;

9) Instruction of the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter – the MFA of the RK  ) is a prompt decision issued in the form of written instruction by the Heads of Diplomatic Missions of the Republic of Kazakhstan, Deputy Directors and Managers of Passport and Visa Department of the Consular Service of the Ministry of Foreign Affairs of the Republic of Kazakhstan taken to solve force majeure and emergency situations including those based on the instruction of the Presidential Administration of the Republic of Kazakhstan and (or) the Government of the Republic of Kazakhstan, appeals of the foreign establishments of the RK, state agencies and organizations of the Republic of Kazakhstan, foreign services, diplomatic and equivalent missions, consular offices of foreign states, international organizations and their representations, based on which the Ministry of Foreign Affairs of the Republic of Kazakhstan (hereinafter – the MFA of the RK) and its foreign establishments shall issue, cancel, reissue, extend or reduce the period of visa validity;

10) Foreign offices of the Republic of Kazakhstan (hereinafter – the RK  foreign offices) are diplomatic and equivalent representation offices, as well as consular offices of the Republic of Kazakhstan; 

11) Departments of the Ministry of Internal Affairs of the Republic of Kazakhstan (hereinafter – the MIA of the RK) are the units of migration police of the Ministry of Internal Affairs of the Republic of Kazakhstan, the Departments of Internal Affairs in regions, cities of Astana, Almaty and on transport;

12) Instruction of the Ministry of Internal Affairs of the Republic of Kazakhstan (hereinafter – the MFA of the RK) is a prompt decision issued in the form of written instruction by the Head (Deputy Head) of Migration Police Department of the MFA of the RK taken to solve force majeure and emergency situations including those based on the instruction of the Presidential Administration of the Republic of Kazakhstan and (or) the Government of the Republic of Kazakhstan, appeals to the foreign establishments of the RK, state agencies and organizations of the Republic of Kazakhstan, based on which the invitations are prepared, visas are issued, cancelled, reissued, extended or reduced in the validity;

13) A petition is a written request of the inviting party about issuance, cancellation or reissuance of the visa of Republic of Kazakhstan extension or reduction of its validity, as well as of a foreigner or a stateless person intending to visit Republic of Kazakhstan;

14) Seasonal foreign workers are immigrants engaged in the work by employers for seasonal work, which by virtue of climatic or other natural conditions shall be carried out within a certain period (season), but not more than one year;

15) Missionary activities are the activities of the nationals of the Republic of Kazakhstan, foreigners and stateless persons on behalf of religious communities registered in the Republic of Kazakhstan, which are aimed at spreading of doctrinal statements in the Republic of Kazakhstan;

16) Certificate of qualification compliance for self-employment (hereinafter – the certificate of qualification) is a document in a prescribed form issued in the manner determined by the authorized body on migration of the population, to a foreign worker who comply with the relevant requirements to the qualification and education level, for self-employment in the Republic of Kazakhstan in the specialties that are in demand in the priority sectors of the economy;

17) Permanent residence permit is a document issued by the Ministry of Internal Affairs of the Republic of Kazakhstan to immigrants subject to compliance with the requirements, and which gives them the right to permanent residence in the territory of the Republic of Kazakhstan; 

18) Authorized officer is an officer of the foreign establishments of the RK, the MIA of the RK and the MFA of the RK, having the right to harmonize a petition and the signature on the visa;

19) Force-major circumstances are events of force majeure happening due to emergency and unavoidable circumstances (natural disasters, acts of war and other similar events);

20) International principle of reciprocity is a mutual provision of equal conditions for issuance of visas for the nationals of the two states;

21) International organization is an interstate or intergovernmental organization;

22) Inviting party is central governmental bodies of the Republic of Kazakhstan, offices of Akims in regions, cities of republican status, the capital, foreign services, diplomatic and equivalent missions, consular offices of foreign states, international organizations and their representations, as well as individuals and legal entities registered in the Republic of Kazakhstan assisting the entry and exit of a foreigner or a stateless person to/out of Kazakhstan;

23) documents of the invitation from abroad (hereinafter – the invitation) is an invitation to enter the Republic of Kazakhstan on personal matters, issued by the MIA of the RK, or the petition of the inviting party, agreed with the MIA of the RK, or a note verbal on the issuance of visa of the Republic of Kazakhstan to foreigners and stateless persons;

24) Foreigner is a person, who is not a national of the Republic of Kazakhstan and has proof of nationality of another state;

25) Ethnic Kazakh is a foreigner or a stateless person of Kazakh ethnicity, who is permanently a resident abroad.

4. Category, recipient, numbers of entry, validity of visas, duration of stay in RK  and reason for issue of visa determines in accordance with the annex 1 of these Rule (hereinafter – form 1). 

5. The visa can be single entry and multiple entries.

Single entry visas entitle the visa recipient for a single entry into the Republic of Kazakhstan, travel through its territory, stay in it and and exit from the Republic of Kazakhstan for the period, for the purposes and on the terms set out in the visa.  

Multiple entry visas entitle the visa recipient for multiple entries into the Republic of Kazakhstan, travel through its territory, stay in it and exit from the Republic of Kazakhstan for the period, for the purposes and on the terms set out in the visa.  

Visas for exit from the Republic of Kazakhstan entitle the visa recipient for staying in the Republic of Kazakhstan and exit from the Republic of Kazakhstan for the period, for the purposes and on the terms set out in the visa.  

6. In case of organized entry/exit of the Republic of Kazakhstan, including transit for groups of foreigners or stateless persons (hereinafter – the visa recipients), the group visas shall be issued.

          7. Visa replacing document are:

1) an accreditation certificate issued by the MFA of the RK to the heads, members of diplomatic and equivalent missions, consular institutions of foreign states, international organizations and their representatives accredited in the Republic of Kazakhstan, as well as members of their families;

2) a residence permit of a foreigner or a stateless person in the Republic of Kazakhstan issued by the MIA of the RK;

3) a certificate of stateless person issued by MIA of the RK;

4) a court decision about deportation of a foreigner from the Republic of Kazakhstan;

5) a refugee’s travel document issued by the MIA of the RK;

8. Visa recipients, categories, number of entries, visa validity and grounds for the visa issue, as well as period of stay in the territory of the Republic of Kazakhstan shall be determined in accordance with Annex 1 to these Rules. The visa category must comply with the purpose of stay of the visa recipient.

          Chapter 2. Procedure for invitations registration and harmonization for entry into the Republic of Kazakhstan to visa recipients 

9. The petition or the note verbal shall be submitted not earlier than 90 days and no later than two weeks prior to the expected date of entry of the visa recipient to the Republic of Kazakhstan.

The term of consideration of the petition shall not exceed 5 working days of the submission, except in the cases referred to in paragraph 16 of these Rules.

In case of instruction by the MIA of the RK and the MFA of the RK, the invitation documents shall be received and processed in a shorter timeframe.

10. In order to register the invitation, the inviting party shall submit to the MFA of the RK the note verbal with the table according to the form set forth in Annex 2 to these Rules.

11. In order to register the invitation, the inviting party shall submit to the MFA of the RK the following documents on the place of registration:

1) to register the invitations for entry into the Republic of Kazakhstan on personal matters:

Proof of identity;

An application form;

Confirmation of state duty payment;

2) to harmonize the petition of the legal entity or individual entrepreneur:

Confirmation letter in the form according to Annex 2 to these Rules, in two copies;

Confirmation of state duty payment;

3) The legal entities and individual entrepreneurs that apply for registration of invitations for the first time in the current year shall submit:

A copy of the certificate of state registration of the legal entity or individual entrepreneur;

A copy of the charter of the legal entity or a patent;

Order of the legal entity to appoint a representative for the delivery of documents or power of attorney;

The receiving party registering the invitation of the members of the Board of Directors – a copy of the minutes of the General Shareholders Meeting on the election of the members of the Board of Directors;

The receiving party registering the invitation of foreign tourists – a license for tour operator activities, issued by the local executive bodies of regions, cities of republican status, capital, or an extract from the State register of travel agencies;

The receiving party registering the invitation the visa recipient for the purposes of education – a license and (or) supplement to the license for educational activity, issued by the authorized body of the Republic of Kazakhstan in the field of education;

The receiving party registering the invitation of the visa recipient for treatment, medical examination or consultation – a license for medical activities, issued by an authorized body of the Republic of Kazakhstan in the sphere of public health.

12. Depending on the category of requested visa the following should be further provided:

1) for investors – the petition of the authorized body of the Republic of Kazakhstan on investments;

2) to apply for a multiple entry Business visa – a copy of the agreement or contract (except for ethnic Kazakhs, former compatriots and nationals of economically developed, politically and migration stable countries specified in the list of countries (hereinafter – the list of countries), in accordance with Annex 3 to these Rules) ;

3) to participate in religious activities or exercise missionary activities – a written consent of the authorized body of the agency responsible for regulation in the sphere of religious activity;

4) to visit persons serving sentences in prisons in the territory of the Republic of Kazakhstan – a written consent of the Committee of correctional system of the MIA of the RK;

5) for the adoption of the nationals of the Republic of Kazakhstan – a written consent of the authorized body of the Republic of Kazakhstan in the field of protection of children’s rights;

6) in order to work, including seasonal foreign workers – a permit issued to the employer to recruit foreign workers, or permit to foreign workers for employment or documents certifying that according to the legislation of the Republic of Kazakhstan and international treaties the visa recipient is not obliged to have such permit;

7) for business immigrants – a petition of local executive bodies of the capital, major cities and the regions of the Republic of Kazakhstan;

8) for practical training or internship – a petition of the central executive bodies of the Republic of Kazakhstan, or a petition agreed with the MFA of the RK of the company and organization registered in the Republic of Kazakhstan; 

9) on humanitarian grounds – a document confirming the accreditation in the Republic of Kazakhstan of the confirming international organization or its representative, or official registration of foreign non-governmental organization (Fund) in the country of its location in accordance with the laws of this country, subject to international agreement on the humanitarian assistance ratified by the Republic of Kazakhstan;

10) for education – a petition of the institution of the Republic of Kazakhstan or the authorized body of the Republic of Kazakhstan on the issues of education;

11) for the care of close relatives – by the nationals of the Republic of Kazakhstan or visa recipients, permanently residing in the territory of the Republic of Kazakhstan and being under treatment in medical institutions – documents issued by a medical institution located in the Republic of Kazakhstan, confirming the need for constant care, as well as documents, confirming the degree of kinship.

13. In considering the petitions in the MIA of the RK the following shall be taken into account:

1) compliance of the submitted documents with the requested purpose of trip, the number of entries, duration and place of visa issue. The place of visa issue shall be determined in accordance with the consular district, to which the country of nationality and (or) a permanent residence of the visa recipient. the MFA of the RK shall submit to the MIA of the RK the list of foreign establishments of the Republic of Kazakhstan with the indication of their operated consular districts;

2) availability of the grounds for refusal of the foreigner in the entry into the Republic of Kazakhstan provided for in subparagraphs 7) and 12) of clause 62 of these Rules;

3) availability of the grounds for refusal of the inviting party in registration of the invitation provided for in paragraph 16 of these Rules.

If the requested purpose of the trip, the number of entries, the validity of the visa or place of the visa issue are not supported by the attached documents, or there are grounds for refusal, the petition shall be returned to the inviting party with indication of the grounds for the refusal in writing.

14.  Documents of the invitation shall be processed by:

1) issuing an invitation to enter the Republic of Kazakhstan on personal matters, certified by the signature of an authorized employee and sealed with the visa stamp of the MIA of the RK;

2) putting a coordination number in the first copy of the petition of the legal entity signed by an authorized officer and sealed with the visa stamp of the MIA of the RK. The second copy of the petition and the attached documents shall be filed in the indexed registered record of the MIA of the RK.

Information about the number and date of coordination shall be uploaded in EIS ‘Berkut’.

15. The petition of invitation to the Republic of Kazakhstan of immigrants shall not be considered, if within one year prior to the filing of such application the inviting party was brought to responsibility for the failure to timely register immigrants, register the documents entitling them to stay in the Republic of Kazakhstan, travel through the country and departure from the Republic of Kazakhstan after a certain period of stay.

16. The decision on processing the documents of the invitation or refusal of its registration shall be made by the authorized officer of the MIA of the RK or the MFA of the RK after coordination with the National Security Committee of the Republic of Kazakhstan.

The coordination with the RK  NSC shall be via EIS ‘Berkut’.

The RK  NSC shall agree the petition within 3 days. In need of a more detailed study of the grounds for the registration of invitations, upon written request of the RK  NSC officials the said period may be extended up to 30 calendar days.

Chapter 3. Issuance of visa of the Republic of Kazakhstan 

Paragraph 1. Documents to be submitted by visa recipients to obtain the visa

 17.To issue visas in the foreign establishments of the RK, in the MFA of the RK and the MIA of the RK at the place of registration of the visa recipient or the inviting party, the following documents and information shall be submitted:

1) The visa application form with a photograph;

2) When applying for visa in the RK, foreign establishment, the number and the date of the invitation, registered in the MIA of the RK or the MFA of the RK  (number and date of the invitation issue to the visa recipient shall be informed by the inviting party), or a petition from the recipient of visa categories provided for in paragraph 17 of these Rules;

3) A valid diplomatic, official, foreign passport or any other identity document, accepted as such by the Republic of Kazakhstan and granting the right to cross the State border of the Republic of Kazakhstan (hereinafter – the travel document);

4) The original receipt of consular fee or state tax payment;

5) The additional documents required to obtain the visa in accordance with Annex 1 to these Rules.

18. A visa application form shall be filled in legibly by hand or using technical facilities in the state, Russian or English languages in the form according to Annex 4 to these Rules.

Answers to questions of the visa application form shall be exhaustive.  

The visa application form shall be signed by the visa recipient personally.

On behalf of minor children the visa documents shall be submitted by their legal representatives.

The visa application form shall have a black-and-white or colour photo with the size of 3.5x4.5 cm. The photo shall correspond to the age of the citizen at the time of applying for the document with a clear image of full face without glasses with tinted lens and without headdress, except for those persons, for whom constant wearing of the headdress is a mandatory attribute of their ethnic or religious affiliation, provided that this person is shown in such a headdress on the photo in the travel document.

19. The travel document provided by the visa recipient must meet the following criteria:

1) it should not cause doubt as about the authenticity and belonging to its bearer, contain no notations, exceptions, notes, erasures and alterations, torn or fixed pages;

2) it must have at least 2 blank pages intended for visas, except for the recipients of exit visas from the territory of the Republic of Kazakhstan;

3) The period of its validity should not expire earlier than three months from the date of expiry of the visa, with the exception of the recipients of exit visas from the territory of the Republic of Kazakhstan.

20. The service on registration of documents of invitation and visa issuance, including reissuance and extension of the duration of its validity shall be charged by the consular fee or the state duty in accordance with the Code of the Republic of Kazakhstan “On Taxes and Other Mandatory Payments to the Budget” dated December 10, 2008 (hereinafter – the Tax Code), unless otherwise stipulated by international treaties to which the Republic of Kazakhstan is the party.

The consular fee or the state duty for registration of documents of invitation and visa issuance shall not be charged in cases stipulated by legislation of the Republic of Kazakhstan.

Visa shall be issued after payment of the consular fee or the state duty in accordance with the RK  legislation.

The amounts of paid consular fees are non-refundable.

21. In case the visa contains any mistake, made by the staff of the foreign establishments of the RK, the MFA of the RK or the MIA of the RK, re-entry visa shall be issued without charging consular fee or state duty.

Paragraph 2. Visa Issuance

4. Visa Issuance Procedure

22. The visas shall be issued:

1) abroad:

The foreign establishments of the RK issue the following visa categories A1, A2, A3, A4, A5, B1, B2, B3, B4, B5, B6 B7, B8, B9, B10, B11, B12, B13, C1, C2, C3, C4, C5, C6 , C7 , C8 , R9 , C10 and C12 (visa categories B14, B15, B16, B17, B18, B19, B20, B21, B22 and C11 are not issued);

2) in the territory of the Republic of Kazakhstan:

the MFA of the RK issues the following visa categories A1, A2, A3, A4, A5, B1, B2, B3, B5, B7, B8 B10, B11, B12, B13, C3, C4, C8, C9 and C12 (visa categories B4, B6, B9, B14, B15, B16, B17, B18, B19, B20, B21, B22, C1, C2, C5, C6, C7, C10 and C11 are not issued);

MIA of the RK issues the following visa categories A5, B3, B14, B15, B16, B17, B18, B19, B20, B21, B22 C3, C4, C9 (for ethnic Kazakhs), C11 and C12 (visa categories A1, A2, A3, A4, B1, B2, B4, B5, B6, B7, B8, B9, B10, B11, B12, B13, C1, C2, C5, C6, C7, C8 and C10 are not issued).

23. the MIA of the RK shall issue, cancel, re-issue, extend or reduce the period of visa validity at the place of temporary registration of the foreigner or the registration of the inviting party, or as directed by the MIA of the RK.

Exit visas shall be issued at the actual location of the visa recipient, with the exception of visas of B14 category.

Education visas shall be issued based on the location of the education institution in which the visa recipient is enrolled.

24. The basis for the issuance of visas in the RK, foreign establishments, the MFA of the RK and the MIA of the RK is the invitation, note verbal, petition or instruction of the MFA of the RK or the MIA of the RK.

The instructions of the MFA of the RK and the MIA of the RK, accepted outside of working hours, shall be registered on the next business day by the MFA of the RK and the MIA of the RK.

25. The RK issues to foreign establishments the following categories of visas without an invitation on the basis of:

1) instruction of the MFA of the RK – A1, A3, B1 and B3 (based on written instructions of the heads of the foreign establishments of the RK, B3 single entry visas are issued, and simultaneously the foreign establishments of the RK issue the application for registration in the territory of the Republic of Kazakhstan (except for citizens of the countries indicated in the list of countries), which is the basis for registration of temporary registration in the MIA of the RK at the place of temporary stay of the visa recipient);

2) the note verbal - A1, A2, A3, A4, B1, B3 and B10;

3) the petition:

to the citizens of the countries indicated in the list of countries (single entry visa up to 30 days) – A3, B1, B3, B10 and B12 ;

to former compatriots – B10 (single entry visa);

to foreigners or stateless persons – B4, B5, B8, B9 and B10 (for funerals or in cases of disease of family members/relatives – single entry visa, for family members or parents of Kazakhstani citizens – single entry visa up to 30 day, for family members of ethnic Kazakhs – single entry visa up to 30 days), B13, C1, C2, C4 (single entry visa up to 90 days) and C10.

Visa documents, including notes verbal and petitions, shall be agreed via and the visas shall be issued by EIS ‘Berkut’.

26. In the cases established by Article 23 of the Law of the Republic of Kazakhstan On the Legal Status of Aliens, the visa recipient refuses to issue a visa to leave the Republic of Kazakhstan.

27. If case there any grounds to prevent the entry into the territory of the Republic of Kazakhstan or exit from the territory of the Republic of Kazakhstan, including in the presence of invitation, visas shall not be issued, and the registered visa is not a ground for entry into the Republic of Kazakhstan or exit from the territory of the Republic of Kazakhstan.

28. For the members of official delegations, citizens of countries with no consular offices of the Republic of Kazakhstan, as well as the recipients of visas on the basis of an invitation or as directed by the MFA of the RK, the visas are issued by the MFA of the RK at international airports of the Republic of Kazakhstan.

29. Copies of the documents for visa B9, as well as the decision of the RK  foreign establishment shall be sent within 30 calendar days from the date of receiving the documents to the MIA of the RK through the MFA of the RK for verification and authorization. the MIA of the RK visa shall be issued in a period not exceeding 3 months from the date of receipt of materials from the MFA of the RK.

30.  Group visas are issued for organized entry of groups of foreigners into the Republic of Kazakhstan and exit from the Republic of Kazakhstan or transit through the territory of the Republic of Kazakhstan.

A precondition for issuance of group visas is simultaneous arrival and passage of checkpoint on the State Border (hereinafter – the checkpoint) by all members of the group at the border, when entering and exiting from the Republic of Kazakhstan, staying at any point and movement in the territory of the Republic of Kazakhstan within a group.

Group visas are issued in the form of name lists compiled in alphabetical order in accordance with Annex 6 to these Rules.

At that the visa shall be stuck to the reverse side of the paper, or on a separate sheet of paper and stitched together with the list by bending the upper left corner, which is sealed by the foreign establishments of the RK, the MFA of the RK or the MIA of the RK, which issued the visa.

An authorized officer shall sign at the bottom of the list (indicating the position and surname), and a signature shall be stamped by the seal of the MFA of the RK, the RK  foreign establishment, the MIA of the RK.

The list, a sheet of paper with visa shall be made in a single copy; the original is issued to the group leader; one copy shall be submitted at the checkpoint at entry (exit) to the Republic of Kazakhstan, the other one remains with the RK foreign establishment, the MFA of the RK or the MIA of the RK  , which issued the visa.  Alterations and amendments to the list are not allowed.

31. In case the visa is issued to a person, who submitted a travel document of the state, which is not recognized by the Republic of Kazakhstan, a single visa shall be issued based on the invitation and pasted on a separate sheet of paper, which shall be seized upon departure of the visa recipient from the Republic of Kazakhstan by representatives of the RK  NSC Frontier Service or after expiration of visa by representatives of the MIA of the RK with subsequent transfer to the visa issuing authorities.

32. Family members as well as persons who are dependent on (the presence of supporting documents) the main recipient of the visa category A1, A2, A3, A4, A5, B7, B10 C3 and C7, the visa is issued for the period indicated in the main recipient’s visa in accordance with these Rules. At the same time family members and persons who are dependent are not eligible to perform labor, religious, missionary activities and / or participation in the activity of a religious association, unless otherwise provided by the legislation of the Republic of Kazakhstan.

33. In case a visa recipient’s travel document contains unused visas, or the validity of which has not expired, a new visa is issued subject to cancellation of a previous visa.

34. Changes in visa from one category to another on the territory of the Republic of Kazakhstan is allowed:

1) by the MFA of the RK:

to categories A1and A3 - on the basis of a note verbal or instructions of the MFA of the RK;

to categories A2 and A4 - on the basis of a note verbal;

2) by the MIA of the RK:

to category A5– from categories B3, B10, C3, C4, C5 and C10;

to category B7 - from category C9;

to category C1 - only for ethnic Kazakhs, regardless of the category of previously issued visa;

to category C3 - from categories B2, B3, C2, C9 and C10;

to category C4 - from categories of B10, C2, C9 and C10;

to category C9 - only for ethnic Kazakhs, regardless of the category of previously issued visa, and for those arrived on a visa-free regime;

to category C12 - from all categories of visas.

35. The number of entries of the visa to be issued from multiple to a single on the written request of a visa recipient on the replacement of entry number of the visa and visa validity on the basis of a completed visa application form (which indicates a single entry visa) and the receipt of the consular fee payment (payment for a single entry visa). At the same time the validity of the visa shall be changed in accordance with the terms set out in Annex 1 to these Rules.

The period of validity shall not exceed the duration specified in the documents of the invitation.

In the foreign establishments of the RK, in the MFA of the RK and the MIA of the RK replacing the entry number of the visa issued from a single (specified in the documents of the invitation) to the multiple one is not allowed.

36. In the study of materials for the issue of the visa, the officer of the RK  foreign establishment, the MFA of the RK and the MIA of the RK shall:

1) compare the content of the information in the application with the information specified in the invitation, travel document and other documents submitted to obtain a visa, depending on the purpose of residence of the visa recipient in the Republic of Kazakhstan;

2) certify that the travel document entitles the visa recipient to return to its country of permanent residence or travel to another country after the visit to the of the Republic of Kazakhstan;

3) in the countries of migration threat, the following actions of an authorized official are possible: telephone interviews with the inviting party, place of work or study;

4) invite for an interview the visa recipient, if the documents submitted cause doubt. During the interview, check the contents of answers to questions from the information in the documents submitted to the recipients of visas for obtaining a visa, as well as information obtained from other sources;

5) check the category, number of entries, validity and duration of stay of an immigrant with the intended purpose of staying of the visa recipient in the Republic of Kazakhstan.

37. When deciding whether to issue, re-issue, cancel, extend the visa, the political and migration situation in the country of citizenship or permanent residence of the visa recipient shall be taken into account.

During the consideration of an application, the officer of the RK  foreign establishment, the MFA of the RK and the MIA of the RK should hold an interview with the visa recipient, in the country of nationality or permanent residence of which unstable political and migration situation is observed.
